Welcome to the House Escort mobile application (“House Escort” or the “App”), operated by House Escort, LLC (“we,” “us,” or “our”). By downloading or using the App, you agree to these Terms and Conditions (“Terms”). If you do not agree with any of these Terms, please do not use the App.


Acceptance of Terms


By creating an account or otherwise using the House Escort App, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms form a legal agreement between you and House Escort, LLC. If you are using the App on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms. Use of the App is also subject to any applicable app store rules (such as Google Play or Apple App Store terms).

Service Usage
 

House Escort provides a platform to connect clients with home service professionals. Through the App, clients can discover and book services from providers such as realtors, contractors, cleaners, caterers, and other house-related professionals in their area. Service Providers can sign up to list their services and connect with potential clients.

When using the App, you agree to the following conditions of service:


Payment and Transactions
 

Note: If you use House Escort purely as a directory and arrange services and payments offline, some of the following may not apply. However, if the App facilitates payments or if you purchase any services or subscriptions through House Escort, the terms below outline how payments are handled.


Prohibited Activities
 

To maintain a safe and trustworthy community, you agree NOT to engage in any of the following activities on the House Escort App:

Engaging in any of these prohibited activities may result in suspension or permanent banning of your account, and if necessary, we may report illegal activities to the authorities. House Escort reserves the right to investigate and take appropriate action against anyone who, in our judgment, violates these rules or otherwise adversely affects the platform or its users.


Liability and Disclaimers
 

Use at Your Own Risk: House Escort strives to vet Service Providers and provide useful information, but ultimately use of the App and any services booked through it is at your own risk. When you enter into an agreement for services with another user, that agreement is between you and that user (Client and Provider). House Escort is not a party to any service contracts and does not guarantee the quality, safety, legality, or outcome of any service. We do not conduct extensive background checks on users, so exercise caution and judgment when hiring or accepting jobs.

No Warranty: The App and all content and services provided through it are provided “as is” and “as available” without any warranty of any kind. To the fullest extent allowed by law, House Escort disclaims all warranties (express or implied) including warranties of merchantability, fitness for a particular purpose, and non-infringement. We especially do not warrant that the App will be uninterrupted, error-free, secure, or that you will obtain any specific results by using it.

Limitation of Liability: To the maximum extent permitted by law, House Escort, LLC and its officers, directors, employees, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (a) your use of or inability to use the App; (b) any conduct or content of any user or third party on the App (including any defamatory, offensive, or illegal conduct of other users or third-party service providers); or (c) any content obtained from the App. In no event will our total liability for any claims arising out of or relating to your use of the App exceed the amount you have paid to House Escort for its services in the last six (6) months, or USD $100 if you have not had any payment obligations to House Escort, whichever is greater. Some jurisdictions do not allow certain liability limitations, so some of these limitations may not apply to you to the extent prohibited by law.

Third-Party Services: The App may contain links to third-party websites or services, or integrate third-party offerings (for example, a payment processor or map service). House Escort is not responsible for any third-party sites or services, and your use of them may be subject to separate terms. We also are not responsible for interactions you have with third parties through the App, except as stated in our role as platform provider.

Indemnification: You agree to indemnify and hold harmless House Escort, LLC and its affiliates, officers, agents, and employees from any claim or demand (including reasonable attorneys’ fees) made by any third party due to or arising out of your breach of these Terms, your improper use of the App, or your violation of any law or the rights of a third party.


Privacy and Data Handling

Our collection and use of personal information through the House Escort App is described in our Privacy Policy (please refer to the Privacy Policy available in the App or on our website). By using the App, you consent to the collection, use, and sharing of information as described in that policy. Here’s a brief overview:

Modifications to Terms
 

House Escort may revise or update these Terms from time to time. If we make material changes, we will notify users by posting the updated Terms in the App and updating the “Last Updated” date at the top, or by other appropriate means. It is your responsibility to review these Terms periodically.

Changes to the Terms will become effective on the date they are posted or on the date we specify in the notice. By continuing to use the App after any changes take effect, you agree to the revised Terms. If you do not agree with an update, you should stop using the App and, if desired, delete your account. For minor changes that do not substantially affect your rights, we may not provide advance notice, so please check the Terms occasionally for any updates.


Governing Law and Dispute Resolution
 

These Terms and any dispute arising from your use of the House Escort App are governed by the laws of the State of Wyoming, USA, without regard to its conflict of law principles, unless applicable law in your jurisdiction requires that your local law govern. If you reside outside of the United States, you may also be entitled to the protection of the mandatory consumer protection provisions of your local consumer protection law.

Dispute Resolution: We truly hope that no serious disputes arise, but if they do, here is how they will be handled: You agree to contact us first and attempt to resolve any issue informally by sending a written notice of your claim to us (via email or postal mail). If we cannot resolve the dispute informally within a reasonable time, you and House Escort agree to resolve any claims arising from these Terms or the App by binding individual arbitration, rather than in court, to the extent permitted by law. This means you are waiving your right to a trial by jury and to participate in class actions. You and House Escort may only bring claims against each other on an individual basis, not as a plaintiff or class member in any class or representative action. Arbitration will be conducted by a neutral arbitrator in accordance with the rules of a reputable arbitration organization (such as the American Arbitration Association) in a mutually agreed location or via remote means, subject to the arbitrator’s authority and applicable law.

Exceptions: In some cases, if your claim qualifies, you may bring it in a local small claims court instead of arbitration. Also, any disputes concerning intellectual property rights or violation of these Terms that result in urgent harm may be brought to court for injunctive relief.

If the agreement to arbitrate is found unenforceable in a particular case, then that dispute will be resolved by the courts located in the State of Wyoming, and you consent to personal jurisdiction in those courts.
