Welcome to the House Escort mobile application (“House Escort” or the “App”), operated by House Escort, LLC (“we,” “us,” or “our”). By downloading or using the App, you agree to these Terms and Conditions (“Terms”). If you do not agree with any of these Terms, please do not use the App.

Acceptance of Terms

By creating an account or otherwise using the House Escort App, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms form a legal agreement between you and House Escort, LLC. If you are using the App on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms. Use of the App is also subject to any applicable app store rules (such as Google Play or Apple App Store terms).

User Eligibility
 

• Age Requirement: You must be at least 18 years old (or the age of majority in your jurisdiction) to use the App. If you are between 13 and 17 years old, you may use the App only with the involvement and consent of a parent or legal guardian. The App is not intended for children under 13, and we do not knowingly collect data from anyone under 13.
• Legal Compliance: You may only use House Escort if doing so is not prohibited by applicable laws. You are responsible for ensuring that your use of the App complies with all local, state, and national laws and regulations that apply to you.
• Service Providers and Clients: House Escort connects two types of users – Service Providers (home and house service professionals offering services such as real estate, contracting, cleaning, etc.) and Clients (individuals seeking those services). Additional eligibility requirements may apply to Service Providers (for example, holding any licenses required by law for the services they offer).

Account Registration
 

To access certain features, you’ll need to create a House Escort account. When registering:

• Provide Accurate Information: You agree to provide true, current, and complete information about yourself as prompted by the registration process. You must update your information if it changes.
• Account Security: You are responsible for maintaining the confidentiality of your account login credentials. Do not share your username or password with others. You agree to notify us immediately at contact@houseescort.com if you suspect any unauthorized access to or use of your account.
• Responsibility for Activity: You are responsible for all activities that occur under your account. If someone else uses your account (with or without your permission), you may be held liable for their actions. House Escort is not liable for any loss or damage arising from unauthorized use of your account.
• One Account: You agree not to create multiple accounts or transfer your account to another person without our consent. We reserve the right to suspend or terminate accounts that violate these Terms or that are inactive, fraudulent, or impersonating someone else.

Service Usage
 

House Escort provides a platform to connect clients with home service professionals. Through the App, clients can discover and book services from providers such as realtors, contractors, cleaners, caterers, and other house-related professionals in their area. Service Providers can sign up to list their services and connect with potential clients.

When using the App, you agree to the following conditions of service:

• Platform Only: House Escort is a facilitator of introductions and bookings. We do not provide the actual home services and we do not employ the Service Providers. Any agreement for services is strictly between the Client and the Service Provider. We simply provide the tools for users to connect and communicate.
• Quality and Scheduling: We strive to maintain a quality platform, but we do not guarantee the availability, suitability, or quality of any Service Provider or service. Scheduling and service fulfillment are managed between the Client and the Service Provider.
• Communications: The App may allow you to communicate with other users (for example, to discuss details or arrange appointments). Such communications should remain professional and related to the intended services. We may monitor or review messages on the platform to ensure safety and compliance with these Terms.
• App Updates and Functionality: We may update, modify, or remove features of the App at any time. We do our best to keep the App running smoothly, but we do not guarantee that the App will be available at all times or free from errors. Temporary interruptions may occur for maintenance or due to technical issues.

Payment and Transactions
 

Note: If you use House Escort purely as a directory and arrange services and payments offline, some of the following may not apply. However, if the App facilitates payments or if you purchase any services or subscriptions through House Escort, the terms below outline how payments are handled.

• Payment Processing: House Escort may enable clients to pay service fees or deposits through the App. We use secure third-party payment processors to handle your payment information. By entering your payment details (such as credit card or mobile payment info), you authorize us to charge for the services or subscriptions you request through the App. We do not store your full financial information on our servers; any payment data is handled in accordance with our Privacy Policy and the payment processor’s security protocols.
• Charges and Fees: You are responsible for paying all fees and charges associated with your use of the App’s services. Pricing for services or any platform fees will be disclosed within the App before you complete a booking or purchase. All payments are due at the time of booking or as otherwise described (for example, a subscription fee might be charged monthly or annually).
• Subscriptions (if applicable): If the App offers subscription services (for example, premium listings or membership for Service Providers), those may auto-renew until canceled. You will be charged periodically (e.g., monthly or yearly) unless you cancel the subscription. You can cancel a subscription through the App settings or by contacting customer support, but no refunds will be provided for partial subscription periods unless required by law.
• Refunds and Cancellations: We want you to have a great experience, but we understand plans can change. Any cancellation or refund policies for a specific service will be stated in the App or agreed between the Client and Service Provider. In general, fees paid through the App are non-refundable once the service has been provided. If you have an issue with a service (e.g., a no-show or unsatisfactory work), please contact the Service Provider first to resolve it. If needed, you can reach out to House Escort support, and we will try to help mediate, but we do not guarantee refunds as the contract for services is between you and the Provider.
• Payment Disputes: If you believe you were charged in error or encounter any payment-related issue, contact us promptly at our support email. We may, at our discretion, assist in investigating the issue. Unauthorized or fraudulent payment use may result in account suspension and referral to law enforcement if appropriate.

Prohibited Activities
 

To maintain a safe and trustworthy community, you agree NOT to engage in any of the following activities on the House Escort App:

• Illegal Use: Do not use the App for any unlawful purpose or in furtherance of illegal activities. You must not request or offer any services that are illegal in your jurisdiction.
• Fraud or Misrepresentation: Do not provide false, misleading, or fraudulent information on your profile or in communications. You must not impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
• Harassment or Abuse: Do not harass, threaten, or harm other users. This includes using abusive or hate speech, sending unsolicited inappropriate messages, or engaging in stalking or discriminatory behavior. Everyone should be treated with respect and professionalism.
• Unsafe or Prohibited Content: Do not upload or share content that is obscene, defamatory, infringing, or otherwise violates any third-party rights (including intellectual property rights). This also means no spamming, no spreading viruses or malicious code, and no posting of others’ personal information without consent.
• Interference with Service: Do not interfere with or disrupt the operation of the App. This means you must not attempt to hack, overload, or disable the App or our networks (no DDOS attacks, automated scraping without permission, or attempts to bypass any security measures). Also, do not try to reverse engineer or decompile our software.
• Circumvention: Service Providers and Clients should not circumvent the platform. For example, as a Client, you shouldn’t solicit a Service Provider to work outside the App in order to avoid fees, and as a Provider, you shouldn’t accept requests to be paid off-platform for jobs found through House Escort. Such actions can result in account termination.

Engaging in any of these prohibited activities may result in suspension or permanent banning of your account, and if necessary, we may report illegal activities to the authorities. House Escort reserves the right to investigate and take appropriate action against anyone who, in our judgment, violates these rules or otherwise adversely affects the platform or its users.

Liability and Disclaimers
 

Use at Your Own Risk: House Escort strives to vet Service Providers and provide useful information, but ultimately use of the App and any services booked through it is at your own risk. When you enter into an agreement for services with another user, that agreement is between you and that user (Client and Provider). House Escort is not a party to any service contracts and does not guarantee the quality, safety, legality, or outcome of any service. We do not conduct extensive background checks on users, so exercise caution and judgment when hiring or accepting jobs.

No Warranty: The App and all content and services provided through it are provided “as is” and “as available” without any warranty of any kind. To the fullest extent allowed by law, House Escort disclaims all warranties (express or implied) including warranties of merchantability, fitness for a particular purpose, and non-infringement. We especially do not warrant that the App will be uninterrupted, error-free, secure, or that you will obtain any specific results by using it.

Limitation of Liability: To the maximum extent permitted by law, House Escort, LLC and its officers, directors, employees, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (a) your use of or inability to use the App; (b) any conduct or content of any user or third party on the App (including any defamatory, offensive, or illegal conduct of other users or third-party service providers); or (c) any content obtained from the App. In no event will our total liability for any claims arising out of or relating to your use of the App exceed the amount you have paid to House Escort for its services in the last six (6) months, or USD $100 if you have not had any payment obligations to House Escort, whichever is greater. Some jurisdictions do not allow certain liability limitations, so some of these limitations may not apply to you to the extent prohibited by law.

Third-Party Services: The App may contain links to third-party websites or services, or integrate third-party offerings (for example, a payment processor or map service). House Escort is not responsible for any third-party sites or services, and your use of them may be subject to separate terms. We also are not responsible for interactions you have with third parties through the App, except as stated in our role as platform provider.

Indemnification: You agree to indemnify and hold harmless House Escort, LLC and its affiliates, officers, agents, and employees from any claim or demand (including reasonable attorneys’ fees) made by any third party due to or arising out of your breach of these Terms, your improper use of the App, or your violation of any law or the rights of a third party.

Privacy and Data Handling
 

Your privacy is important to us. Our collection and use of personal information through the House Escort App is described in our Privacy Policy (please refer to the Privacy Policy available in the App or on our website). By using the App, you consent to the collection, use, and sharing of information as described in that policy. Here’s a brief overview:

We do not sell your personal data to third parties. • Data Security: We implement standard security measures to protect your information. However, no app or website can guarantee 100% security. You are responsible for using a strong password and protecting your account. Notify us if you suspect any unauthorized access to your data.
• User Communications: By providing your email or phone number, you agree that we may send you service-related communications (e.g., booking confirmations, updates, or support messages). You can opt out of non-essential communications (like newsletters or promotions) at any time.
• Privacy Choices: You may have certain rights regarding your personal data under applicable privacy laws (such as accessing or deleting your data). Please see our Privacy Policy for details on how to exercise those rights and for more detailed information on our data practices.

Changes to the Terms will become effective on the date they are posted or on the date we specify in the notice. By continuing to use the App after any changes take effect, you agree to the revised Terms. If you do not agree with an update, you should stop using the App and, if desired, delete your account. For minor changes that do not substantially affect your rights, we may not provide advance notice, so please check the Terms occasionally for any updates.

Governing Law and Dispute Resolution
 

These Terms and any dispute arising from your use of the House Escort App are governed by the laws of the State of Wyoming, USA, without regard to its conflict of law principles, unless applicable law in your jurisdiction requires that your local law govern. If you reside outside of the United States, you may also be entitled to the protection of the mandatory consumer protection provisions of your local consumer protection law.

Dispute Resolution: We truly hope that no serious disputes arise, but if they do, here is how they will be handled: You agree to contact us first and attempt to resolve any issue informally by sending a written notice of your claim to us (via email or postal mail). If we cannot resolve the dispute informally within a reasonable time, you and House Escort agree to resolve any claims arising from these Terms or the App by binding individual arbitration, rather than in court, to the extent permitted by law. This means you are waiving your right to a trial by jury and to participate in class actions. You and House Escort may only bring claims against each other on an individual basis, not as a plaintiff or class member in any class or representative action. Arbitration will be conducted by a neutral arbitrator in accordance with the rules of a reputable arbitration organization (such as the American Arbitration Association) in a mutually agreed location or via remote means, subject to the arbitrator’s authority and applicable law.

Exceptions: In some cases, if your claim qualifies, you may bring it in a local small claims court instead of arbitration. Also, any disputes concerning intellectual property rights or violation of these Terms that result in urgent harm may be brought to court for injunctive relief.

If the agreement to arbitrate is found unenforceable in a particular case, then that dispute will be resolved by the courts located in the State of Wyoming, and you consent to personal jurisdiction in those courts.

Miscellaneous
 

• Termination: You may stop using the App at any time. We also reserve the right to suspend or terminate your access if you violate these Terms or if we need to discontinue the App. In the event of termination, sections of these Terms that by their nature should survive (such as Liability and Disclaimers, Governing Law, etc.) will continue to apply.
• Entire Agreement: These Terms (along with the Privacy Policy and any additional terms within the App that apply to specific features) constitute the entire agreement between you and House Escort regarding the App. They replace any prior agreements or understandings between you and us regarding the App.
• No Waiver: If we don’t enforce a provision of these Terms, it doesn’t mean we waive our right to do so later.
• Severability: If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms will remain in effect.
• Assignment: You may not transfer or assign your rights or obligations under these Terms to anyone else without our consent. We may transfer our rights and obligations to another party (for example, if ownership of the App changes) – if we do so, we will notify you.
